General Terms of Use

Preamble

These General Terms of Use determine the rules for accessing the website www.wizzvet.com and its conditions of use, which the user acknowledges accepting, without reservation, solely by connecting to the site.

Editor of the website

WIZZVET is a simplified joint-stock company with a capital of 40,000 euros, headquartered at 4 Rue Boussingault – 67000 STRASBOURG. It is registered with the Registry of Commerce and Companies of STRASBOURG under the number 793 230 616.

"WIZZVET" is a matchmaking platform offering a source of tele-expertise. WIZZVET administers this platform as a business facilitator. Its purpose is to facilitate the connection between, on the one hand, members wishing to provide online services and, on the other hand, members wishing to access these services. WIZZVET is thus a technical intermediary.

These advisors and users will be referred to as participants on the platform.

This contractual document hereby aims to define the rights and obligations of the participants in the use of the platform "WIZZVET", as well as the role and responsibilities incurred by the Simplified joint-stock company WIZZVET in the administration of the platform.

In the event that one or more provisions of these general conditions become invalid, the validity of the other provisions shall not be affected.

By registering on WIZZVET, you agree to the general terms of use described below. You declare that you have read and approved them.

These General Terms and any document to which they expressly refer represent the indivisible contract that binds WIZZVET to the user regarding the subject matter of any Contract and supersedes any prior agreement, understanding, or previous arrangement, whether verbal or written.

A. Object

1. Acceptance of the General Terms of Use

By clicking on the "I agree" module, you agree to abide by and be bound by these terms of use, the privacy policy, the quality charter of referees, and, where applicable, any attached documents and all rules, policies, and warnings of the site (collectively the "Terms").

If you do not agree with all the terms, please do not use the Site. We ask you to review all Terms before using the Site.

By requesting a service from our site, you warrant that you are a qualified veterinarian and that you are a member of the professional order of your country/province or region governing the practice of veterinary medicine where you practice, or that you are a student following veterinary studies recognized by the Veterinary Board of the country in which you are studying.

2. Definitions

These terms of use apply to three defined entities below:

The participant or user: any veterinarian or veterinary student with an account registered in their name and possessing confidential and personal codes.

The referring advisor: any experienced veterinarian recognized by the platform in terms of professional experience or holding a diploma from the European or American College, or a national diploma granting them the title of specialist in their country of practice.

The Client: any participant who has subscribed to one or more services offered by the Wizzvet platform, through a monthly subscription or a one-time purchase.

Service: service provided by the referring advisor of the platform at the request and for the benefit of the user.

Tools: technical and human means used by participants on the WIZZVET platform.

3.Electronic Communication and Right to Modify Conditions:

WIZZVET reserves the right to modify the general terms of use at any time as well as to evolve the tools used within the framework of the platform.

It is reminded that the WIZZVET platform has intellectual property rights and that users cannot use the content of the site such as photographs, images, or comments for public dissemination under any circumstances. Any exploitation of these materials will be subject to prior written authorization from WIZZVET (support@wizzvet.com) and the concerned author.

WIZZVET communicates by email or by posting notices on this site. You agree that all agreements, notices, information, and other communications will be provided to you electronically when you visit WIZZVET or when you send us emails.

You agree to provide and maintain your WIZZVET account profile up to date.

B. The Website

1. Third-Party Content

WIZZVET is a place for informational and educational purposes to allow users to ask questions and attend online training sessions in the form of live webinars, replays, podcasts, or any other medium, and for referring advisors to answer questions, conduct webinars, podcasts, or provide other training materials.

Referring advisors are not employees of WIZZVET.

WIZZVET is not involved in the conversations between users and referring advisors.

WIZZVET is not responsible for the acts, content, or omissions of referring advisors, their messages, the ability of referring advisors to answer questions, or users' ability to pay for answers.

2. Publication of Content

Comments and solutions provided for clinical cases will be published without the possibility of identifying the animal. The user will have the choice to associate or not their identity with the publication of the clinical case or question.

Consultation services can be provided in French or in the language agreed upon between you, the user, and us, the service provider. The language used in the contract will be one of the languages included in the agreement.

WIZZVET is not responsible for the content of sites or links inserted by participants.

In no event shall WIZZVET be liable for any direct, indirect, or other damages resulting from the use of these internet links.

The site is an innovative collaborative platform on the Internet. The information and documents submitted in the content of your questions, answers, information requests, profiles, signatures, qualifications, comments, and platform messages through which users communicate are not private or confidential among platform members. For example, search engines may index your questions, answers, and other posts to enable them to appear in the search engine results of WIZZVET. To better protect your privacy, you can post questions while masking your identity. In this case, the name "WIZZVET" will substitute for your identity.

3. Verification of Referring Advisor Quality

Each referring advisor on the site holds a diploma from the "European Board of Veterinary Specialization" or the “American Board of Veterinary Specialization” or is recognized by the profession in their discipline.

Details regarding the verified identification information for each referring advisor are available in the charter of referring advisors. Any other information provided by referring advisors is not verified by WIZZVET.

The use of the term "referring advisor" by WIZZVET is solely intended to describe participants who answer questions, conduct webinars, podcasts on the site, and defines a high level of expertise.

In no event shall WIZZVET be liable for the content of information provided by the referring advisor, loss of earnings, or even loss of opportunity.

4. Information about the Service

Users are responsible for their cases and the treatment of their patients. The recommendations provided should be applied to the individual case. Dosages of medications should always be verified before administration or prescription.

The responses of referring advisors on WIZZVET must be used by users as diagnostic aid information and not as a diagnosis.

Before benefiting from the advice of a referring advisor, it is mandatory to accept these terms of use and sale.

5. Limitation of Access to Site Features

Users registered as veterinary students only have access to non-paying features of the site unless they subscribe to a subscription. In this case, they can access the entire content of the site. However, registration on the site does not allow them to access the medical opinion exchange service between specialist veterinarians, as this service is reserved for duly qualified and licensed veterinary professionals within the country where they practice.

C. User Accounts

1. User Accounts: Suspension or Termination of Service

a. Creation of a Personal Account

Creating an account and accessing the network is free of charge.

Subject to the specific conditions applicable to referring advisors, students and professionals who meet the following conditions can register:

Veterinary medicine students:

Those individuals with a student ID and enrolled in the last two years of their university course.

Professionals:

Those considered as professionals:

  • Generalist veterinarians
  • Specialist veterinarians
  • Medical practitioners specializing in the animal field (physiotherapist, kinesiologist, homeopath, osteopath...)

Professional practice must comply with French law and European provisions. Each professional must have a VAT number.

Prior registration on the platform is mandatory before using WIZZVET by the participant. The participant must proceed with the creation of their personal account via an online form.

Through these provisions, the participant acknowledges that providing any inaccurate, incomplete, false, or outdated information when registering on the WIZZVET platform may incur their liability both towards other participants and WIZZVET. It is up to the participant to determine which information will be visible on WIZZVET, except for mandatory fields.

The participant undertakes to keep their profile up to date.

In case of erroneous or misleading information, WIZZVET reserves the right to delete or suspend the personal account until the participant rectifies the data.

b. Allocation of Confidential Identifiers and Access Codes

WIZZVET authorizes the creation of the personal account and assigns confidential access codes and identifiers after checking and verifying the participant's data.

TThe identifiers will consist of the participant's email address as well as their first and last name. These confidential access codes correspond to a password composed of numbers and letters that the participant can subsequently modify according to the procedures outlined in the "Modification of Confidential Access Codes" section.

Access codes are strictly personal and confidential. It is the participant's responsibility to take appropriate measures to prevent third parties from accessing this data.

The participant agrees not to disclose them to any third party and will be deemed solely responsible for their safekeeping and use. They will be liable for the actions and conduct of any person using their confidential codes and thus their personal space on the platform. Consequently, WIZZVET shall not be liable in this regard unless it is demonstrated that the codes were obtained through a breach of the WIZZVET site.

WIZZVET reserves the right to request any participant to change their confidential codes in whole or in part when deemed necessary in view of the technical and security provisions of the platform, and the participant cannot oppose it.

Any action or service provided by the participant will be recorded on the platform and will be identifiable by their confidential codes.

c. Modification of Confidential Access Codes

For the security of the personal space, the participant undertakes to change their confidential codes when they have reason to believe that the confidentiality of their codes has been compromised or that an unauthorized person has had or may have access to these confidential codes.

When changing the confidential codes, WIZZVET will automatically record the modifications, and the new confidential codes will replace the old ones.

For additional security, participants are advised to inform WIZZVET in the event of malicious acts by third parties (hacking, viruses, etc.).

d. Legality of Published Content

By accepting these general conditions, you agree that the content you insert on the site:

  • Is not fraudulent, inaccurate or misleading;
  • Does not infringe on the property rights of a third party or rights of publicity or privacy;
  • Is not illegal or violates current regulatory provisions;
  • Is not defamatory, obscene, or pornographic;
  • Does not contain viruses, Trojan horses, or other computer programming routines that could damage, interfere harmfully, surreptitiously intercept, or expropriate any system, data, or personal information;
  • Does not hold WIZZVET liable or cause it to lose (in whole or in part) the services of Internet service providers or other providers.

You are reminded that you cannot resell or commercially use WIZZVET or its content without the prior written consent of WIZZVET

It is prohibited to solicit users of this site, including referring advisors, for commercial purposes (including inviting other users to contact you outside of the Site or participate in a website competing with WIZZVET).

In the event of non-compliance with the general terms of use,WIZZVET is granted the right at any time to suspend or even delete all or part of the disputed account or to take any necessary measures to restore the proper functioning of the platform.

e. Termination

You may terminate your personal account at any time by written notification by email to support@wizzvet.com.

The processing of the termination request will be effective within 15 days after receipt of your termination notice. Termination fees will be payable as specified below.

f. Participants' Personal Data

WIZZVET is committed to protecting the privacy and personal information of platform participants.

This section explains the procedure by which WIZZVET collects the personal information of participants and describes the conditions for the use of personal data by WIZZVET.

f-1. Use of Personal Data

WIZZVET is responsible for collecting and processing the personal data declared by participants during their registration.

This personal data is defined as data relating to the personality of its author and includes the name, email address, postal address, landline phone number, mobile phone number, etc. This data constitutes the means of identification of the participant and contributes to maintaining relationships with the platform.

The information collected is subject to computer processing aimed at improving the management of the platform's content and limiting access to unqualified persons.

The recipients of the data are the participants and partners of WIZZVET.

You may also, for legitimate reasons, oppose the processing of data concerning you.

WIZZVET undertakes to process all data in accordance with the principles of loyalty and confidentiality and in accordance with the law of January 6, 1978, amended on August 6, 2004, relating to the protection of individuals with regard to the processing of personal data.

This personal data will be used by WIZZVET for connecting participants and settling transactions.

They may be communicated by WIZZVET upon judicial requisition from administrative, judicial, or police authorities.

By accepting the General Terms of Use, participants accept that their personal data may be transmitted to WIZZVET's partners and agree to be contacted for educational purposes.

If participants do not wish this transmission of information by partners, it is their responsibility to inform WIZZVET at the following address: support@wizzvet.com

f-2. Data Rectification

In accordance with the "computer and liberties" law of January 6, 1978, amended in 2004, you have the right to access and rectify information concerning you, which you can exercise by contacting support@wizzvet.com

g. Payment data

The payment for transactions concluded on the platform via the secure payment service Payzen can only be made by creating a personal account.

This payment can be made with a Bank Card issued by banking institutions or by SEPA direct debit associated with the transmitted IBAN.

WIZZVET does not retain the participant's credit card numbers.

The security of transactions will be guaranteed by the presence of the logo.

By accepting these general conditions, the participant agrees that their relationship with WIZZVET shall be governed by French law regardless of the user's or referring advisor's country of residence and regardless of the territory of execution of the service or corresponding payment.

h. Data Collection

These pieces of information include IP addresses and cookies or invisible files.

WIZZVET ensures the conservation and storage of IP addresses for each participant's action for platform administration purposes, as well as to terminate or remedy any possible abuse from a personal account. The processing of IP addresses is essential for the operation of the platform and the provision of tools.

2. Charges and Service Policy

WIZZVET allows the participant to ask questions to referring advisors in all veterinary disciplines and facilitates communication with referring advisors via chat, emails, and online messaging systems. WIZZVET allows the participant to obtain answers, as well as access to other services such as live and replay webinars, podcasts, and responses from specialists on community cases present on the platform.

Procedure for connecting in clinical cases:

When a user wishes to benefit from a service from a referring advisor, they must first register and accept the general terms of use, as well as the details of the services for advice.

Establishment of the relationship and payment of the transaction:

After making the payment and accepting the pricing conditions of the service in question, it is automatically set up for live and replay webinars, access to podcasts, and other clinical tools.

To optimize the payment process for subscribed services, the Client expressly consents to WIZZVET managing the automatic debit from their bank account. By doing so, the Client specifically authorizes WIZZVET to perform this operation on their behalf, providing the necessary banking information to establish a SEPA direct debit order.

This authorization allows Wizzvet to collect the amount of subscriptions or agreed services, in accordance with the General Terms of Use accepted by the Client. This authorization is valid until explicitly canceled by the Client, which must be done in accordance with the procedures provided in the general terms of use.

In the case of questions about clinical cases, each user selects one or more disciplines. The question is then transmitted to the chosen discipline(s) and displayed on WIZZVET.

Once the online application for our services is completed, you will receive an email acknowledging receipt of your request. Please note that this notification does not constitute an approval of your application but merely an acknowledgment indicating receipt of your request and confirmation of your intention to use one of our services. Such an offer is subject to our approval. Once the offer is approved, we will send you a second acceptance email. The contract between you and us will then be formed upon sending this second email confirming acceptance. This second email will contain your username and temporary access code to complete your service request.

Referring advisors generally respond promptly, either to request additional information from users before responding or to provide a direct response.

It is specified that:

WWhen a referring advisor is available and requires additional information to respond to the question, it is important for the user to be available to communicate directly with them in order to obtain a prompt response.

Once a response from a referring advisor is received, you will be asked to provide your opinion on the usefulness of the response.

This opinion will be personal, anonymous, and discreetly given through a points system.

The mere request for connection does not constitute a firm offer of acceptance of the services by the referring advisors.

Payment for the advice will only be effective when the referring advisor has accepted to perform the service.

If the requester believes that the handling of the request in a specific discipline is delayed, they may ask support to relaunch the community of referring specialists.

In the case of payment per case and in the event of a delay in handling the request by a referring advisor, the user may also withdraw their request in favor of other referring advisors.

Their right of withdrawal can only be exercised if the request is not being processed by one of the referring advisors on the platform.

During processing, the service is deemed to be effective and cannot be retracted by the user.

As a veterinarian, you can choose between two payment modalities: the "pay per question" model (1) or the subscription model (2).

WIZZVET does not guarantee that you will receive a response from a referring advisor or that you will be satisfied with your communication with them.

WIZZVET takes user satisfaction seriously. Therefore, all suggestions or complaints can be sent to WIZZVET via email: support@wizzvet.com

3. Receipt of Special Offers and Others

By accepting these conditions, you agree to receive special offers and other communications from WIZZVET in accordance with the terms of the Privacy Policy.

D. Legal Statements

1. Discharge/Settlement of Disputes between Participants

WIZZVET does not participate in the relationship between the referring advisor and the user.

It is specified that the user cannot appeal to WIZZVET for all material and immaterial damages, whether consequential or not, suffered by users or caused to third parties resulting from an error in diagnosis or advice.

All dispute resolutions will be subject to amicable settlement between the parties. Regardless of the nature of complaints, questions, or claims, these should be addressed to the respective referring advisor, who is accordingly insured, and not to WIZZVET.

In the event that such amicable settlement fails, WIZZVET should be informed via customer service: support@wizzvet.com. WIZZVET will then intervene to attempt an amicable resolution between the participants.

Users are responsible for their acts and/or omissions and the content placed on the site.

In case of conflict between an oral or written representation by a WIZZVET referring advisor and these terms, the latter shall prevail.

If any provision(s) of the Terms is deemed by the competent jurisdiction to be contrary to the law, it shall be declared null and void but the other provisions shall remain in force.

WIZZVET does not participate in the liability in the event of disputes between the referring advisor and the user.

2. Intellectual Property Rights

Every participant agrees to respect the data issued by other participants. They are prohibited from violating the security of the platform by any means, hacking it, or introducing viruses.

WIZZVET is not responsible for the content of sites or links inserted by participants.

Under no circumstances shall WIZZVET be liable for any direct, indirect, or other damages resulting from the use of these internet links.

The user also undertakes to inform WIZZVET of the discovery of such links so that WIZZVET can remove them as soon as possible.

With regard to software protection,WIZZVET declares that it holds all rights related to the software in accordance with intellectual property law. It holds copyright to images and content and has the exclusive right to exploit the software.

WIZZVET does not authorize the use of photos, content, texts, software, music materials, sounds, photographs, videos, graphics, or other elements contained in ads, sponsor advertisements, or distributed emails posted for any use or provision, via publications, on other sites without its prior written consent. If necessary, WIZZVET must also seek permission from the copyright holder.

The WIZZVET trademark and logo are subject to intellectual property protection with the National Institute of Industrial Property(NIIP).

Any act or attempt at counterfeiting is punishable by the provisions of the Penal Code.

Likewise, you must not modify, disassemble, decompile, disassemble, or attempt to derive the source code of the WIZZVET site, or assist any other person or entity to do so, modify, copy, reproduce, publish, download, display, transmit, or distribute in any way whatsoever the content available via the Service, including the code and software for commercial purposes.

Finally, you agree that messages on the site, videos, photos, ideas, comments, and testimonials you submit onWIZZVET, including the WIZZVET pages on www.facebook.com, www.instagram.com , www.linkedin.com , www.youtube.com or www.google.com shall not be considered confidential and may be used by WIZZVET at its sole discretion, without any financial or other compensation for use.

3. Relation with Users

a) Creation of a Personal Account:

Registration on WIZZVET is free. Each user will need to fill out the registration form, mentioning the mandatory fields.

b) Processing of Personal Data:

The user acknowledges that the information he/she provides on the platform is his/her sole responsibility.

c) User Obligations:

The user agrees to participate on the platform in good faith and with the aim of receiving the service of a referring advisor.The user must refrain from making defamatory or discriminatory remarks, respecting the privacy and professionalism of the participants, and from posting images or photographs of a discriminatory or pornographic nature.

Any dispute over the quality or conformity of services must be handled according to the procedures set forth in Section IV of this document.

It is prohibited for the user to obtain, through the platform and referring advisors, illicit services not covered by the provisions of this document.

The user agrees to comply with legal and regulatory provisions as well as all conditions of this document.

The user must pay the transaction in accordance with the payment terms provided in Section III of this document.

It is the responsibility of the user to evaluate the accuracy, completeness, and usefulness of any advice from the referring advisor.

4. Storage of Information

These include IP addresses and cookies or invisible files.

WIZZVET ensures the conservation and storage of the IP addresses of each participant's action for platform administration and accountability purposes, as well as to terminate or remedy any possible abuse from a personal account.

The processing of IP addresses is essential for the operation of the platform and the provision of tools.

Additional tests and other documents transmitted by the user to the referring advisor will be kept for one (1) month, except for documents attached in the report.

WIZZVET does not control the information provided by users, which may be shocking, offensive, inaccurate, or misleading.

By accepting these terms, you agree that WIZZVET is not responsible for the deletion or failure to store the content of the information.

5. Responsibility and Sanctions

In the event of non-compliance with the terms of service, WIZZVET reserves the right to suspend or delete the contentious account or take any necessary measures to restore the proper functioning of the platform.

These measures will initially consist of a warning. In case of recurrence, WIZZVET may suspend the personal account and, in more serious cases, delete it.

WIZZVET will not be held responsible for any disputes between the referring advisor and the user.

Under no circumstances will WIZZVET be liable for the content of the information provided by the referring advisor, loss of earnings, or loss of opportunity.

Its liability will be limited to the proper functioning of the platform, including providing tools for connecting participants, acting as an intermediary, and its obligation to monitor personal data.

All our consultants who provide advice through our website have assured us that they are part of the professional order in their region that governs the practice of veterinary medicine where they operate, and that they are covered by professional liability insurance.

WIZZVET strives to ensure the smooth operation of the service but cannot be held responsible for temporary unavailability of the service or technical failures (such as delays in responses).

Technical difficulties or maintenance operations may result in temporary system outages.

In the event that WIZZVET decides to cease operation of its services, a 30-day notice period before the cessation of WIZZVET is provided to allow participants to have the information they need.
